I've been firmly in the camp that I'd rather see President Obama invoke the 14th Amendment in the debt ceiling debacle than strike a bad deal. Earlier today I realized I had made that decision without really thinking though all of the ramifications that could arise.
So I decided to read the amendment. Now I'm not so sure. So I thought I'd reach out with a diary outlining my concerns and ask the wider community here to help me (and maybe others) understand the legal ramifications of a court challenge.
Specifically, will invoking the 14th Amendment open the entire amendment for judicial review or just Section 4?
If it opens the entire amendment to review, do we need to worry about what will happen to the Section 1 clause as it pertains to naturalized citizens, due process, and equal protection?
