    Programmers are already exempt. The definition of an exempt computer professional before this amendment is:

    (17) any employee who is a computer systems analyst, computer
    programmer
    , software engineer, or other similarly skilled worker,
    whose primary duty is -
    (A) the application of systems analysis techniques and
    procedures, including consulting with users, to determine
    hardware, software, or system functional specifications;

    (B) the design, development, documentation, analysis,
    creation, testing, or modification of computer systems or
    programs, including prototypes, based on and related to user or
    system design specifications;

    This amendment just clarifies "other similarly skilled worker" and the reason for it is that companies often didn't pay these employees OT in the first place and have been the subject of large misclassification lawsuits.

    I don't support the amendment, but I don't support the idea of exempting anyone. It should be all or nothing. It is especially ridiculous, however, to suggest a programmer should be exempt but a DBA isn't.
