    When Youtube removes a video based on a DMCA notice, you can file a "counter-notice" if you believe the material was removed erroneously.

    Youtube will reinstate the video unless the party that claimed copyright goes to court to file a response.

    Now Rush has the deep pockets obviously to take the next step, but he isn't likely to prevail in court and would have to pay court costs, etc.

    Unfortunately I have to remove pirated copies of my film from Youtube fairly regularly, but those are instance where people are ripping it off.  This usage would clearly seem to fall into "fair use" category.

      is a site that is impervious to DMCA notices.  I hate the site because they rip off movies at will with no regard for legit copyright, but you could easily post the video there and no one could touch it.
