    Some states have controls.  Others do not.  That's why Congress created federal standards 40 years ago.  When EPA gets around to setting the federal standards, they have to survey the states, see who has real rules, and incorporate those rules into the federal standard.  Basically, level the playing field for those states who stuck their neck out.  Will take a while, but this is what's next.

    By the way, EPA can do about 80% of Waxman-Markey laid out without any legislation.  I wrote a law journal article about that last year (published by Fordham).  It's less intensive than many think.  And less industry friendly than many may fear.
