    and unless the railroad owns the creek and every place the creek water goes to, they can't claim it as a private accident that doesn't affect anyone.

      regular oversight from government, companies were always ever having an effect on the public and their immediate neighbors.  Not to mention workers also.

      Point being that they can't and never could claim that they had no impact outside of their what they believed to be their own realms.

      In this case, someone's bathtub is going to end up with some of that creek water in it.
