I have to say I was stunned that the Supremes didn't punt on Prop 8. The 9th Circuit decision was so narrow it would be easy for them to refuse certiorari and just let it become legal in California only.  So, does this mean they'll use the case to legalize marriage equality everywhere, or to allow it only if states say they want it, or to ban it everywhere?  I don't know what Roberts will do, as he seems a dyed-in-the-wool corporate supremacist, but he's come down on the wrong side of other social issues.  But he doesn't want to end up on the wrong side of history, so that is pushing him into becoming a swing vote himself.

I am going to be really annoyed if they rule that Prop 8 was legal. The only upside to that tragedy would be that our 2/3 supermajority in both houses would put the repeal amendment up for a vote so we don't have to spend millions gathering signatures.  And. It. Will. Pass. By. A. Huge. Majority.  Unfortunately, not until June 2014.
