soldiers on the battlefield. There is a whole different set of rules that apply to them. The Geneva convention. So you are either a criminal subject to American law and courts with constitutional protections or you are a Prisoner of War entitled to protections. Well the Bush administration created a class of person who was neither a criminal nor a POW. He was an enemy combatant. Who had no protections. This only applies to the US. That means if we declare someone an enemy combatant we can keep him permanently, secretly, and torture him with the stated goal of obtaining information. Prisoners are at Guantanamo so that they are denied criminal rights, access to lawyers, and courtrooms. they can be taken to other countries to be tortured by CIA and other agents with no paper trail.

Either the 9/11 plotters are criminals that need to be tried for their crimes. Or they are enemy soldiers just doing their job. I believe they are criminals who need to be tried in a US courtroom. But Bush and now Obama  believe that it is too dangerous to try them for their crimes and instead hold them without release until they die after they have been tortured to the satisfaction of some CIA case officer.

People have been tried and convicted by international courts for this kind of stuff and with our support. But we exempt ourselves from international law that we demand all other countries live by.
