    To be noticeably impaired at .11  

    I mean compared to alcoholics who wander around at .15 most of the time and get up to .3 when they have a night out on the town.

    If that yellow had been just a tad longer, he wouldn't have been noticed and made it home.  His case sounds a lot different than the other type of drunk driver, the one who routinely gets behind the wheel at .2 or more and drives real slow so the cops won't notice (or so he thinks).

    Just think, if he just had another cup of coffee (I know, another vile beverage) relaxed for a half hour and taken a good long whiz, he never would have got caught.

      IIRC it wasn't that many years ago when DUI was 0.15%, though .1 might have counted towards something.  At .11, some people are significantly impaired though I suspect others more tolerant of alcohol are barely impaired, no worse than being tired.  The law at .08 now errs on the side of safety, which is not a bad thing.  At that level, many peoples' reflexes are impaired.

      So he might not have thought he was impaired at all.  He probably was not drunk, which usually requires quite a bit more.  I think two beers (but not the 3.2 kind), or a couple of glasses of wine, can probably get you to .11.

        I pulled over and took a nap on a wide shoulder of US 1 on the PA side of the DE-PA border about 2 am some time in 1979 or 1980. I was awakened a few minutes later by some state cops who gave me a breathalyzer and I blew .14. It was legal, so all they asked me to do was to find a better location to nap.

        I had drank quite a number of Busch beers that night. That stuff must not have much alcohol in it or I would have definitely been illegal. I was really not in a good condition to drive at that number.
