    We can't pass laws saying that only people who become irresponsible or severely impaired when drunk may not drive while drunk; therefore, we prohibit drunk driving across the board.

    Maybe a better example would be the fact that we require guard rails around dangerous drop-offs, because we can neither assume that all people will be sensible and stay away from the edge nor legally distinguish between sensible people and foolish risk-takers.
