    to private actors. Mental health care professionals 1st bottom line on all evaluations is "Is the patient a danger to themselves or others?"

    This is really not much different. It asks for that question to be fine tuned down to whether the person is likely to use a weapon to harm themselves or others... a question most mental health care professionals would probably love to be able to ask in order to help save lives.

    What concerns me is when the information gets handed over the the Division of Criminal Justice Services... then what? What criteria do they use to judge whether someone should have their license revoked or not? And what happens with information that would otherwise be protected health care privacy information? How is it handled, tracked, removed? What recourse does the person have to appeal the determination? And so forth.

    But as to your #2... yeah... better treatment first. Legal action second.
