...violating the user agreement, which can now be punished as a felony crime rather than as a violation of a contract.

A diary written today by one of Aaron's colleagues has more info: http://www.dailykos.com/...

It's almost universal practice that internet users don't read the user agreement before checking the little box. It's not that people are lazy. It's simply against human nature to read the fine print in an environment where everything is geared towards clicking away and getting what you want immediately. That's not necessarily good, but it's the culture.

That a violation of that agreement can be charged as a felony is entrapment. It's like rounding up everyone at a baseball game who left peanut shells under their sits.

      •  I've always thought that (0+ / 0-)

including non-negotiable subtleties in dense legalese in a 6-point font is bullshit to begin with, even if it's legal. And I mean bullshit in the "Everything I Needed To Learn, I Learned In Kindergarten" sense.

I mean, none of us have the power to charge our cell phone providers with fees when they drop calls and so forth....

Capitalism = unequal power relationships, guaranteed.
