I'm not sure though what the best way is to physically limit fire rate, though.

Also, if they are going to start again classifying assault weapons based on cosmetic features like pistol grips, thumbhole stocks, or folding stocks, then they ought to at least exclude rimfire weapons from these definitions of assault weapon.

There's got to be some middle ground, where "semi-auto" means something less than full-auto, but where every modded 10/22 isn't being classified as an "assault weapon" because it looks scary.

    •  sigh. My 550 Remington .22 is illegal in NY now (2+ / 0-)

      because it's got a 15-round magazine.

      It's not that I don't believe a .22 can kill.

It's not that the .22 rimfire isn't way cheaper to shoot (and in general the firearms made for its use are also themselves way cheaper to purchase and maintain).

And believe it or not I'm not advocating for having to give up my .22.

It's that I think we've got to find a better way than ramming more laws through quickly and without debate or consideration of the implications the laws of unintended consequences always bring forward.

So rate of fire strikes me as as at least one good qualification.

loaded with more than 15 rounds? And is that magazine removable?

I see what you did there.

          •  Yours may be exempt..... (0+ / 0-)

            along with my Marlin 60:

"Large capacity ammunition feeding device" means a magazine, belt, 22 drum, feed strip, or similar device, that (A) has a capacity of, or that can be readily restored or converted to accept, more than ten rounds of ammunition......provided, however, that such term does not include an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition
I think the 550 is tube fed?
            •  that's the original AWB, not the 2013 NY law, (0+ / 0-)

              isn't it?

              •  I think this is what just passed (0+ / 0-)

                http://open.nysenate.gov/...

It's section 38.  Search for S 38, or just search for "rimfire".

                •  would that be this section (0+ / 0-)
Section 38 of the bill amends Penal Law 265.00(23) to ban all large
capacity magazines that have the capacity to hold more than ten rounds
of ammunition including those that were grandfathered in under the
original assault weapons ban and creates a new ban on magazines that
hold more than seven rounds of ammunition. Magazines that can hold
more than seven rounds but not more than ten rounds and are currently
possessed will be grandfathered in, but may only contain seven rounds
of ammunition. Exceptions are made for large capacity magazines that
                  are curios or relics.
when I searched for "rimfire" I didn't get any results.

That's just from the summary though.  The language in the actual section includes the exception for tube fed rimfire.

S 38. Subdivision 23 of section 265.00 of the penal law, as added  by chapter 189 of the laws of 2000, is amended to read as follows:

                     23. "Large capacity ammunition feeding device" means a magazine, belt,  drum, feed strip, or similar device, [manufactured after September thir-teenth,  nineteen  hundred  ninety-four,] that (A) has a capacity of, or  that can be readily restored or  converted  to  accept,  more  than  ten  rounds  of ammunition, OR (B) CONTAINS MORE THAN SEVEN ROUNDS OF AMMUNI TION, OR (C) IS OBTAINED AFTER THE EFFECTIVE DATE OF THE CHAPTER OF  THE LAWS  OF  TWO THOUSAND THIRTEEN WHICH AMENDED THIS SUBDIVISION AND HAS A CAPACITY OF, OR THAT CAN BE READILY RESTORED  OR  CONVERTED  TO  ACCEPT, MORE  THAN SEVEN ROUNDS OF AMMUNITION; provided, however, that such term does not include an attached tubular  device  designed  to  accept,  and capable  of  operating  only  with,  .22 caliber rimfire ammunition OR ....., etc.

                    •  Then we're good on 2 counts: (0+ / 0-)

.22 caliber rimfire, only AND made before September 13, 1994 -- Remington stopped building rifles like mine in 1970.

Or are they only permitting weapons made later than that date?
