    illegal. Or at least it won't if it's interpreted in the same manner as the 14th Amendment.

    The 14th Amendment makes it illegal for the government to discriminate on the basis of race (among other bases), but it doesn't extend to private entities. Congress tried banning private discrimination during Reconstruction, but the Supreme Court shot it down in the Civil Rights Cases.

    Title VII of the Civil Rights Act was passed as an exercise of Congress's Commerce Clause powers.
