  •  Can someone tell me how we would enforce this? If (0+ / 0-)

    someone sells to their neighbor or criminal to criminal in the world can you tell if they didn't do a background check....we have 310 million weapons out there and the vast majority are not registered anywhere.  So how can we enforce this?  

    I am all for it as long as there is a valid point to it all.  The point needs to be getting guns out of the hands of criminals, and yet if they don't do the background checks...when they sell to each other, then what is the point?

    Criminals are not buying wheelbarrows full of weapons out of gun shows.  Only 2% of guns used in crimes are ever traced back to a licensed dealer at a gun show.  Even then a majority of that 2% are stolen guns from the legal person who brought it at a show.

    Criminals buy from each other, or they steal them.  They don't go to Academy or the local Gun and Ammo place.  So even if you make the new law, they will not honor it....any more than they honor the laws on the books now.

    Hard core stiff mandatory sentences for anyone who commits a crime with a gun.  If you get caught with a gun and your a felon...incredibly stiff mandatory sentence.  Mental health care funding...This is the stuff we need to talk about.

      Lots of criminals buy guns by way of 'straw man buyers'.  Happens in the Chicago area (helping arm the gangs) and happens in places like Arizona (helping arm the Mexican drug cartels.)  It drives me crazy when Righties scream about Fast & Furious when something like 2,000 guns a day travel from the US into Mexico, and they come from AZ and TX gun shops selling to straw-man buyers who then sell them to "ants" who smuggle 2 or 3 across the border.  There are a lot of ants moving guns from the US into Mexico.  And the NRA turns a blind eye, as do the gun sellers and the gun makers, because everybody is making lots and lots of green.

      because we have a Swiss Cheese record of what guns are actually out there.  Additionally, people don't even have to report that their guns are stolen in many places.

      Figuring this all out because of the number of firearms already out there is going to be a two decades long project.

      40% of guns used in crimes in Chicago have been traced back to ONE GUN SHOP just outside the city limits.

      What you're really asking is, "How the hell are we going to clean up this mess?"  The answer is, "By starting and it will take time, but it is NOT impossible to do it."

      if you are in a mandatory seat belt state riding without a seat belt? Nothing. Unless you are pulled over for any other reason and law enforcement notices you are not in compliance, in which case it's extra penalties for you!

      That's basically how this is going to work.

        felon now, and you go to jail.

        However, If you are legally allowed to have gun, you are fine....and even with new background law, how would anyone ever know......Cop catches you with a gun and you are not a felon:

        New law in place...."where did you get your gun, sir? Did you do a background check?"  

        "No, bought it in 2012, prior to the law."

        "Oh, ok....just asking"

        or perhaps

        "Where did you get your gun, sir? Did you do a background check?"  

        "Oh this gun....had it for years, my Daddy gave it to me."

        "Oh, ok....just asking.  Have to do that , you know."

        End of story.
