    the financial crisis would have happened anyway and Kerry would have lost reelection and we might be facing a Republican president with sizable majorities right now. Plus, we don't know if Ginsburg, Stevens, and Souter would have retired under Kerry, so it's quite possible we could have gained, then lost the majority on the court anyway.

    I do agree though, that it was rather odd to see O'Connor not retire during Bush's first term, but honestly it's even weirder to see someone like Rehnquist, who was clearly a Republican partisan and not just a conservative stay on when he had health issues. O'Connor at least retired of her own free will and will probably have lived through a few presidential terms after Bush's 2nd.
