    in their brief they accuse both Vaughn Walker and Stephen Reinhardt of judicial "impropriety", Walker for being gay and Reinhardt for having a spouse who works for the ACLU.   Their brief is pretty scathing on both points, in very ill-advised ways.  On Walker:

    [H]aving in his personal life rejected 6,000 years of moral and religious teaching, we can see how Judge Walker could readily determine that California voters were motivated solely by "moral and religious views..."
    In addition to the awful grammar (hello, dangling participle!), they use the phrase "secret life" a number of times to paint Walker as bound by "his community of fellow homosexuals."  In Reinhardt's case their main argument is based on an editorial at powerlineblog, so... yeah.   This is going to go over really well with SCOTUS.
