    possibly grounds for different charges or sentencing. The telling aspect of the defense he can afford will be whether his prior offenses can be brought up - as opposed to if he was a black dude, with a public defender, caught in a different scenario where he was basically a bystander.

    The previous offenses and this one bring alcoholism into the possibilities. Alcoholic 'blackouts' are a form of amnesia that occur while conscious. Not remembering to control unacceptable behavior and lack of impulse control under the influence lead to a lot of criminal behavior.

    I am wondering if the airline crew gets any trouble. They usually won't serve more alcohol for someone acting under the influence. The problem with some drunks is they can drink far more than most before it starts to affect their behavior.

      when he boarded, so if there are corroborating witnesses for that.

      If it is established that airline negligence in serving him how does that come into play? As an aggravating factor? Or a mitigating factor?

        years and have no idea what the airlines have established for their employees. Just that they had cracked down quite a lot. It wouldn't mitigate his offense, it might put the servers in some kind of disciplinary situation from the airline.

        I am not aware the carriers have the kind of legal culpability that a bartender does in serving on the ground.

        The history contributes to a pattern of behavior, which contributes to the probability of alcoholism. Depending on laws and jurisdiction, sentencing could include evaluation and rehab as appropriate. Mel Gibson got an ETOH rehab order as part of the DUI conviction when he cut loose with the antisemitic remarks.

        on flights. He also could have been drinking in the airport before boarding, which is also probably on a CC. I am sure the investigators will get copies of that.
