  •  Certainly the fat cop (8+ / 0-)

in the beginning was VERY interested in getting his hands dirty.  That is my opinion.  It was obvious from the conversation that was picked up that they knew the guy.  They stopped him every night or so according to the conversation they had with him.  SO perhaps the cop was a little tired of not having an ID on him or having to tell him the same thing over and over.  I don't know what it was but I watched him just harass and provoke the victim.  My interpretation was the cop wanted him to make some kind of move to give him an excuse.  And when it didn't seem to work he threatened him.  Couldn't hear it all but something about "see these fists or see these hands".

2/3rds of the video was just aggravating.  Just watching the cop messing with the homeless dude.  But the last third was horrendous.  Some damage was done already by the two initial cops - sounded like his ribs may have been broken.  But once the reinforcements arrived it was an all out free for all.  Kelly's calling out for his Dad broke my heart.  This was a plain out and out murder no doubt in my mind.

in the first video, when a cop says "We ran out of officers, and I took the end of my Taser, and I just about smashed his face to hell."

Based on the medical examiner's report in video #3, this was probably the cause of death.

And this all could have been avoided by a different approach from the start.  The first two cops handled the stop poorly and especially the large one, kept working real hard to provoke the victim so that they could respond.  The problem gets exacerbated when the assistance arrives.  They arrive with no knowledge of why there is a struggle.  The assumption is that the "perp" is violent and must have done something.  Meanwhile the man is in pain and having difficulty breathing.  Not only are his words of a compliant meaning from the audio we know there was a very compliant tone to them.  "Put you arm behind your back" is answered with "OK... I'm sorry... give me a second...I can't...wait... I'm sorry, sir....  I can't breathe..."

Every player in this murder gets lost in the event and can only see their assumptions.  The arriving cops assume a violent "perp" and a brother officer in need of help.  With 6-8 cops on the scene.  It would not do any harm to release the man.  He won't get anywhere far.  Let up, get him to comply with words.  Heck he was compliant through much of the interaction until the fat cop elevated his threats.

submissive tone and any content ("I can't breathe", say) he uttered.
He might as well have been speaking another language.
They couldn't hear him because he was an object only by then it seems...not a person
