    It's worth mentioning that when Scalia talks about "black districts by law" he's referring to the fact that Section 2 of the Voting Rights Act has been interpreted (Thornburg v. Gingles, 1986 and Bartlett v. Strickland, 2009) to mean that in a given area, if minorities constitute more than half of the voting population, they should be grouped in the same district.

    There were, as can be seen by reading the text of those decisions, very compelling reasons for this. Most notable among those reasons is the indisputable (and backed by solid evidence) fact that the votes of whites in those areas are largely swayed by race and, until this remedy was employed, various methods of gerrymandering the vote the other way were commonplace. It is impossible that Scalia can be unaware of these reasons. He just doesn't care.
