  •  The point of hate crime status (8+ / 0-)

is that, once designated, local law enforcement can't ignore the crime.  This was once the routine outcome of murders of LGBT people:  Law enforcement learned the sexual orientation of the victim and dropped the investigation.  "He/She was asking for it.  Case closed."  With hate crime designation, local law enforcement if forced to investigate and to prosecute, and there may be an actual conviction.

So it's not so much the extras in punishment as it is that the legal system actually works as advertised in the case of murders and assaults of LGBT people.

    •  I see the problem from the other end (0+ / 0-)

You argue that hate crimes are needed so that killers aren't let off the hook.

I'm also arguing to not let killers off the hook.  But not just those who committ hate crimes, but all of them.  How is "He/She was asking for it, case closed" justice if the man/woman is straight.

So I'll say it again, why don't you force law enforcement to investigate / prosecute ALL murders?

      You're talking in circles.

It's not as though hate crimes designation will reduce the chances of law enforcement investigating murders of white straight people.  Those are precisely the murders that will be investigated anyway.  It's the murders of racial minorities and LGBT people that get tossed to the side.  Hence, hate crime designation makes it more likely that all murders will be investigated.

And who, precisely is talking in circles?
