    ... but it seems to me that the reason why the approval of the commanding officer is required for a court martial decision is strictly to allow the command to accommodate for necessity of service.

    It's not meant to give the commanding officer an opportunity to give a second opinion on the judgement. That would be the job of an appeal court.
