  •  Yes Doma Section 3 that allows states to (4+ / 0-)

    deny full faith and credit to valid marriage licenses issued by non-discriminating states in order to discriminate against same-sex couples.

    Even if DOMA section 3 is ruled unconstitutional, it will still be possible for a state to refuse to issue a marriage license to a gay couple but they would have to recognize the validity of licenses from other states.

    Seek not that the things which happen should happen as you wish; but wish the things which happen to be as they are, and you will have a tranquil flow of life.

      Section 3 abjures Federal benefits.  Section 2 exempts states from the Full Faith and Credit Clause. Only Section 3 is before SCOTUS right now.

      For a number of reasons, the admission that Section 2 is unconstitutional will happen at the same time that laws banning same-sex marriage are struck down universally. So, yes, it's days are numbered, too.

      I mean, a gay couple could just takes a trip to SF to get married in CA then.

      Am I missing something?

      If this is the result, then all the H8er states will be doing is to drive a bunch of big $$$ spent on weddings into the coffers of the states that allow marriage.    I'm sure SF won't mind.
