    Up until this case, it was legal for states to impose religion on it's peoples as the 1st amendment refers to the federal government not the states themselves. Many of the founding colonies had state religions and imposed religious tests for all sorts of things and they also tithed people to support the state religion. As states became more diverse, some got rid of these laws but until the 14th amendment came along, things were still the same.
