    backfire as soon as the relevant authority comes back with a "we have not found a violation of the law" conclusion.  That will all but prove that it was a staffer doing the recording, since, in a one-party consent state, any person in the conversation may consent to having the whole conversation recorded.

    The more I read, the more I expect that to be the outcome.
