    Since the voices were clearly audible in an open public space, there's probably a case to be made that the discussion, while perhaps not intended to be public, was public. Thus, the recording would be legal.

    Not knowing the specific wording of the law, and not being a lawyer, I wouldn't know for certain, but it seems reasonable that there's no expectation of privacy for a conversation that takes place, audibly, in a public location.
