    this was a case of mistaken identity, and being on anti-anxiety wouldn't result in the loss of weapons anyway.

    Go to the first link, read it, then re-read this diary.  I think you will find the characterization of what happened is basically non-sensical.

    There was a fuckup (taking the wrong guy's guns), but it wasn't the fuckup described in this diary.

        I may have misstated this slightly.  The guy they mistakenly took the guns away from MAY have, completely by random fluke, been on anti-anxiety meds.  So, when his guns were taken away, he (and his lawyer) assumed it was because of the meds.  Given the way things go, that was not entirely unjustified.

        The reality, however, was that it was a case of mistaken identity...the meds, if he was taking them, had nothing to do with the taking of his guns--cause they thought they were taking someone else's guns. In the end, the mistaken identity was sorted out, and the guns returned.

          They had his name, his firearms permit number, his address, his phone number, etc.

          That's not a mistake.

          We also know that HIS medical records were illegally accessed, without a court order.

          The after-the-fact claims of "mistaken identity" don't hold any legitimacy here.

            The guy got his weapons back...BECAUSE THEY TOOK THEM FROM THE WRONG GUY.  Sorry to yell, but nothing you said in this comment makes any sense.

            After further investigation, State Supreme Court Judge William Boller has ruled that the police information that was the basis for the action was "in error."
            Justice Boller writing that the "individual named pursuant to the New York Safe Act was not in fact the above named Licensee."
            "What happened here is the State Police got it wrong," added Jacobs.
            The question now is who is responsible for the mix-up
            They fucked up, got the wrong guy, so

            They DID NOT HAVE his name, DID NOT HAVE his firearms permit number, DID NOT HAVE his address, DID NOT HAVE his phone number, etc....they mistakenly had confused this with some other schlub, for which we have no information.

              "(Buffalo, New York) For the record, it is our position that the New York State Police targeted our client, Mr. Lewis, from the outset of their request that his pistol license be suspended. New York State Police officials provided Erie County Clerk Chris Jacobs with our client's name, address, pistol license number, number of handguns owned by Mr. Lewis, and other identifying information that made it clear they were looking for our client. Our client was contacted by the New York State Police. This is not a simple case of mistaken identity. Mr. Lewis's medical privacy was invaded and he was publicly defamed and humiliated by New York State officials. We will file suit shortly.
              Maybe we have no other info for the other "shlub" because there isn't one and they are lying.

      as well?  The whole picture hasn't been revealed yet.

      And what I've presented here is more accurate of what is contained in the first link.

      I call this cross-referencing.

      The State police called the Erie County Clerks office and told them this man's firearms permit must be revoked and his guns seized under our new law.

      The Erie County Clerk complied.  The man was ordered to bring his permit and firearms and all accessories to the police station where they were confiscated.

      The man went with his attorney and then filed a petition before Supreme Court Justice Boller, who then ordered the police to return his property.

      HOW the State Police got his name or the fact that he was on anti-anxiety medications HAS yet to be revealed.  Or HOW they mistook him for someone else!  

      Who were they looking for? We still don't know.  
      What were they looking at?  We still don't know.
      Where did they get their information from? We still don't know.
