    Large explosions like this one simply do not occur in properly operated facilities that are up to code.

    There's a reason why people use fertilizer in car bombs, and it's not that it smells bad afterwards.

    I have a strong presumption that criminal charges will be filed in this case.

      isn't used in bombs. That's ammonium nitrate, which is a solid fertilizer.

      Anhydrous is distributed in tanks and injected into the ground.

      governs.  Negligence is criminal in this instance.  Recklesness is a felony.  

      Here's the deal.  If you kill someone from what happens with a hazardous substance, you're up the creek.  Even if you were just negligent.  You don't have to acted with intent to harm, just having the harm enough meets the criminal definition.  

      This is a mom and pop.  They're gone forever.  The owners, if they are still alive, have a big problem.  Any insurer they have will be paying BIG claims.

        If a big explosion happens, you can be pretty sure it's criminal somehow! And with dozens of people killed, even more so.

        Freak accidents can happen in even well run facilities, but they are very low probability enough to be almost discountable. If your giant fertilizer plant explodes, it's criminal out of the gate.
