federal charges always take precedence over state charges

FBI's been involved from the beginning.

    •  IF it is terrorism -- which depends on motive -- (1+ / 0-)

it's automatically federal. But even if it's not, there would be fed jur due to the explosives, I suspect, plus now they've done stuff to interfere with a federal investigation (clever, that one) and used WMDs and done any number of other things that will allow the feds to take it if they want. Which they will, although that doesn't mean they'd seek death, necessarily.

    •  The state does have jurisdiction for most of this (1+ / 0-)

Several murder charges clearly apply. Many, many others. Whether they ever get to this point is something I can't predict.

But he'll be charged with federal terrorism charges up front. MA doesn't have the death penalty, but federal charges of terrorist acts does.

I just hope he'll be captured alive.

Right now they're reporting that he's covered with blood and not moving any more. He hasn't taken fluid in almost 24 hours. He was injured last night. So the loss of blood is important. He's been shot again, so this is time-critical now.

Gotta get him outta there and get an IV into him ASAP. He wasn't in shock a half hour ago, but this can happen quickly. Once that happens, organ failure soon follows and it's difficult to revive anyone.

They really, really want to capture him alive. If they'd just stop firing dozens of bullets into him, maybe they'd have a better chance of that.
