      Lots of people have sex all the time without explicit consent and it isn't rape.

      That calculus doesn't change if one or both parties are drunk.

      If someone is unconscious or extremely close to it, that's one thing.

      But being drunk and making bad decisions is something else entirely.

        If she's too drunk to consent, it is rape. Legally, anyway.

        Now, good luck getting a conviction, but if they think they can, you'll be charged. At least in MA.

        A sober guy can tell the difference between passive, drunk acceptance, and consent. A drunk guy? Not so much.
