    Inappropriate procedure is one thing, but does not amount to lying.

    "Smear" was an emotional tell.

      Anthony Weiner sent pictures of his erect penis to women whose ages he could not confirm.  Is that a "smear"?

        He did it. It's not a smear to say he did.

        I don't know if there's a legal definition of the exact word smear. (Of course, I do know there's the similar concepts of libel and slander.)

        It brings up the interesting point of whether the diarist is in doubt as to whether Tsarnaev's actually made the statements or not.

          If they have the facts, they should be revealed or presented throughout the course of a trial.

          Why taint the jury pool by releasing selective "quotes" before a trial?

          Is it that unreasonable to ask that they do not try anyone in a court of public opinion? We are talking about their inappropriate actions here, right?

          And isn't that what Jesselyn has pointed out here today?

          The first draft of history is always in the newspapers, of what has been reported.  Does it make it accurate or correct? Nope.

              The facts must be determined through a trial.  

              So far all we've heard is what the government believes and what they say he said and what they say he did.
