    What the DOJ did was completely legal and, at best, para-Constitutional.  That is the problem.

    The failure to reverse the warrantless shortcuts that have been introduced into the law in terror of terrorism is the problem.

    And the Congress is talking about redoing the AUMF for the global war on terrorism to leave it open-ended and give the President even more power.  That is a big huge problem.

    The Congress has been systematically destroying checks and balances that protect civil liberties in the name of getting things done.  For all the talk of balance, the shift is in the direction of presumption of guilt, not presumption of innocence.  The direction has been arbitrary searches and seizures without warrants or with rubber stamp judges.

    Houston, we have a problem.
