    but agreed to by the parties on a case by case basis. On what grounds would they be challenged? No one who is divorced in Texas is required to have a morality clause in their divorce agreement. If these clauses were required by Texas law, then I would enthusiastically agree with you that they would not be constitutional.

      that gay couples have no remedy that will please the state. Straight couples can simply marry if they wish to stay together.

      The divorce papers were signed by both, true, but it stands to reason that this woman would have thought twice about signing if she could have foreseen her predicament.
