      Like the notion of corporate personhood, the State Secrets Privilege arose from a gross error in a Supreme Court case. In United States v. Reynolds, the evidence wouldn't have revealed any state secrets, but it would have revealed records of problems with the aircraft that crashed. The government lied to cover it up.
      Maybe the ACLU can challenge the State Secrets Privilege as well.

      +++ The law is a weapon used to bludgeon us peasants into submission. It is not to be applied to the monied elite.
