    Because something is 'legal' does not make it legal. Meaning, he may be standing up for constitutional law by making himself a test case.  He's surely risking his freedom, if that isn't American I don't know American.  

    He's taken the risk onto himself alone, whether or not anyone agrees that he was right (I do, but I wouldn't have risked execution over it). I can see someone disagreeing over principles, and I can see someone thinking he was dangerously wrong, but, he didn't kill anyone, and he spared our government an expensive investigation, and you can't challenge it in the courts to find out if it's legal if the government won't admit they're doing it.
