    IANAL, but according to the news article, Crocker yelled to the men, told them they were trespassing, shot a warning shot into the air and another shot into the ground near them.  

    They argued with him, traded insults, then picked up rocks and ran towards him.   If Crocker had been hiding in the woods watching them, then shot the man sniper-style, it might be considered first degree.

      "premeditation" to me. I've seen any number of cases where premeditation has been said to develop in pretty short order. Like "yeah at first you didn't want to kill him, but by the time you did you were already thinking about it."

      There can be no protection locally if we're content to ignore the fact that there are no controls globally.
