    NSA wiretap.    All of this information aquired and coming previously taking custody of all of your internet and phone data (everything) because of a wiretap not authorized or disclosed to the American people.

    The physical means of obtaining the chest is the government conducting a wire tap scooping up everything and taking custory of it.  

    Part of my problem with the chest analogy is that everything in it was aquired by this fundamental violative act of a wire tap (in places like ATT data centers) where NSA gets everything--- don't forget that they once called what they are doing "total information awareness"

    The idea  that the government can scoop up everything and take custody of it and that the field of application of the 4th amendment abdicates all prior restraints on wiretaps....and just becomes an exercise on what database searches that NSA can make....that is repugnant to supporters of the 1st and 4th amendment.   It is an attempt to disregard to overwhelming presence of a wiretap on the American people.

    The NSA wiretaps can never be disregarded when evaluating the legality of what information the NSA gains access to.

    A wiretap on all Americans by the NSA is a hostile act by NSA against the people of the United States.   The NSA's activities wiretaping everyone in the United States is a hostile military act against American citizens.   The Founding Fathers found in necessary to ban the quartering of troops by home owners because the military of the country would be restrained in America, unlike what colonists were previously subjected to.   NSA doesn't just want to be quartered in our home, but our minds.....a total invasion of privacy and the path to a totalitarian society.

      ... with kharma that the best possible legislation to come out of this would be a bill that, in no uncertain terms, violently prohibited the Government from keeping or assembling chests of information that contain US Person content.

      On the other hand, what's to keep the Government from requiring the commercial carriers to keep what content they have for longer in their systems? That way, they can go back to search whatever content remains with a search warrant. We've got to catch up to the internet age.
