    the ones kept by guardians they would not be endangered.  However, since they are very susceptible to human respiratory viruses they do not want to release them back into the wild population.  Since they can also carry the virus after symptoms disapear  I am sure that is why they can only release about half of the ones the have.

    In Arizona you are supposed to have your tortoises registered with Game and Fish and follow the rules for tortoise guardians which include not releasing them, not breeding them and not selling them.

      In what I've found about this, there was a reference to many of the turtles being "too feeble" to release into the wild.  I don't even know what that means.  I do know that, in Florida, with the gopher tortoise, there is a concern about possibly spreading disease by relocating, along with the effect on the tortoises of relocation.

      So they just bulldoze over them and pay a fine.  From Defenders of Wildlife

      Gopher tortoises are threatened by habitat loss, logging, disease, and road mortality.When developers want to build on an area that is gopher tortoise habitat, they either have to relocate the tortoises or take out an incidental take permit and then bulldoze over them. The gopher tortoises that are relocated often don’t stay in their new location. They try to move elsewhere and can be run over by cars.

      they've been in captivity over 6 months because of the respiratory virus issue.
