    •  Kissick v Huebsch et al (5+ / 0-)

ACLU of WI site;  That's where the preliminary injunction came from that prohibited the DoA from enforcing its permit requirements for groups of 20 or fewer.

The entire point of that injunction was to allow the plaintiff, Professor Michael Kissick, the ability to join in the sing along without fear of arrest.  Conley put the injunction in place because Kissick demonstrated a likelihood of succeeding in having the permitting requirements ruled unconstitutional, but refrained from enjoining the whole thing in order to narrowly tailor it to the case before him.

I think it's fair to say that it's not achieving its goal.  Conley has got to be seriously, seriously pissed at the DoA's wilful misrepresentation of his injunction and the mockery they've made of it since.  Huebsch et al have got to know that early next year at trial their case is going down in spectacular flames.

Conley's biggest issue is going to be tailoring a smackdown that doesn't prevent the police from declaring actual unlawful assemblies per Wisconsin law (e.g. where injury to persons or damage to property can be reasonably believed to be imminent - although that applies well to the Capitol Police themselves these days) while preventing Erwin from unreasonably claiming to believe anything convenient to his masters.

Fake candidates nominated by the GOP for the recalls: 6 out of 7. Fake signatures on the recall petitions: 4 out of 1,860,283.
