    He should not have slut-shamed the girl, who was already troubled enough to have ultimately killed herself (and thus could not defend against the vile accusation that she was a slut).  He needed to base his decision on the case at hand, such as the fact that the former teacher violated the agreement that he had made with prosecutors.

      Sure, he could have been all about slut-shaming a dead girl, that's certainly possible.

      But he could also have been recognizing her capacity under Montana law to give a limited degree of consent to sexual intercourse with an adult, and alluding to her having consented in this case.

      I really don't know. My only point was that Montana law appears to be a little more nuanced when it comes to sexual intercourse between adults and 14 yr olds than one would think by reading the discussion of this particular court case.
