    set a precedent for a lot of other organizations to sue on similar grounds.

    Also, if they could win this, it might make the oil companies think twice before doing things that lead to horrific situations like this:

    But, then, probably not, they would probably see it as the cost of doing business if they ever had to really lay out any money.

      Just think what this could do for all those areas where fracking is going on, without meaningful oversight.  Where power plants are fighting against installing pollution controls.  Where mining operations, especially Mountain Top Removal style operations, are permanently altering watersheds and poisoning groundwater and the companies either declare bankruptcy to avoid lawsuits or they merge and spin off a shell company to which is given all the liability and none of the profits.

      I fully expect, however, for the money to be put into this to make that board go away or become friendly to industry.  Precedents are bad things to have happen.  It might embolden the 99%.
