"(and again, this is America.. anyone can, and usually does, sue)"

Absolute nonsense. This is the sort of far-right claptrap you see in Republican email forwards on tort reform. I'm surprised you thought you could just slip it in here unchallenged.

Unless you've got some backup for there being a huge amount of citizens who sue willy-nilly over frivolous issues that you'd like to present...?

      Which confuses me.

Ever work in a courtroom or a law firm?  Ever work in a corporate HR department?  Ever work in an Organization Risk Management role?

I've seen lawsuits filed that boggle the MIND.  Every single termination is reviewed by HR and/or legal with the expectation that we can ALWAYS be sued, whatever utterly laughable mixture of horseshit and wishful thinking goes into the complaint.

You want the data, use the Google.  The Public Law Research Institute did a decent study on this a few years back at the request of the California legislature.  They found that most cases are kicked out on a demurral, a motion to dismiss or a straight summary judgement.  Only a fraction of a fraction of a fraction make it to trial and of THOSE, the employer still wins most of the time and actual punitive damages are awarded less than 10% of the time.

I have murkier harder questions to research then America's litigiousness like what color the sky is or whether water is wet.
