  •  lot more to it then that (11+ / 0-)

he obeyed the gag order, while the other side hired a pr firm.  so, his side was never heard, while the other side was heard far and wide.  this is why people have a very one sided view of this case.

huis side:  they were high school sweethearts.  they were engaged.    he begged and pleaded with her to marry when she became pregnant with the child.  she cut him off.

every court has affirmed that he did not voluntarily terminate his parental rights. this is why the sc family court unilaterally terminated them in 2011.  what this means to me is, the child was never available for adoption.

in a nutshell, he was tricked into signing adoption papers, four days before he was scheduled to deploy to iraq.  he thought he was signing full custody to the mother  because he was deploying to a war zone.  unmarried parents who are deploying often take this step.   he never appeared before a judge, had no witnesses, was not informed of his rights, did not even realize that the papers were for an adoption.

he has fought for four years - her entire life - for his daughter.   he was awarded custody two years ago - after he returned from iraq-  and has been raising her for the last two years.

the adoptors have fought him every step of the way, even to the supreme court.  they have been in oklahoma for the last seven weeks.  i would love to know who has been paying for the legal team, the pr team ( they have had a pr team handling the online commentary....their ay around the gag order, i suppose)  the private camera crew ( yes, they have had a camera crew following them around, even to the child's preschool) the hotel bills, their food....they have not been at their jobs, they have been in oklahoma.  who is paying for all this?

anyway, when he failed to show up at a court date because he was on active duty and was not allowed to leave, south carolina slapped him with a felony carrying a five year prison term.  this would end his military career and deny him his military pension.   everyone knew he would be on active duty...why schedule the hearig for that day?

when the child was handed over to her adoptors a week ago, she was screaming "i don't want to go. i don't want to go."

her grandfather had a heart attack as she was handed over.

and now, the adoptors are suing the father for a half million dollars in legal fees.

THIS is what adoption has become.

the message is clear; fight us and we will grind you into powder.

now, i recieved the same message for the social worker who took my child.  she threatened to have me involuntarily committed, involuntarily sterilized, and to take any subsequent child i ever might have if i ever spoke about her threats.   so, the threates and all have not changed al tat much.

what is different about this case is that this time, they chose someone who had the resources to fight back.  most people who are so poor they even consider adoption do NOT have the resources to fight.    the other difference is that because he fought, this time it's all been public.

this time, the whole world is watching.

    here is his side.

    •  Dusten did not sign adoption papers. (6+ / 0-)

At one point you say he was "tricked into signing adoption papers.". He didn't. He was tricked into signing a paper which simply served notice that someone else wanted to adopt his daughter, that the legal process for that had begun.

      Nothing more.

He hired an atty to help him fight the adoption the next day.

      •  read the paragraph above the one you cite (5+ / 0-)

he was tricked into signing something that he thought was full custody to the child's mother, but was held forth in court to be consent.

he never signed consent, and i said so in the paragraph above the one you cite.

that child was NEVER available for adoption, in my opinion.

the fact that the south carolina family court unilaterally terminated his parental rights this year is PROOF that he never terminated his rights.

he saw a jag four hours after signing the acceptance of service.

    •  He can't afford a pr team. Could there (5+ / 0-)

be a support group for him?
While he was serving his country, they stole his daughter.

      •  he is not the first soldier in the last two years (9+ / 0-)

google terry achane.  and terry was MARRIED to the child's mother.

there is so much more to the brown story.   as in, the solicitor general whose office was involved in consultations to issue the felony charge in south carolina was endorsed by the charleston tea party last election. as in, the woman who heads  one of the organizations involved in all this ( christian alliance for indian child welfare) is an unabashed tea partier.  as in, the attack on icwa and the tribes that all this represents.  and then there is the agency involved - "nightlight christian adoptions", they of snowflake embryo adoptions that george bush loved so much.

i do hope to read more on kos about this.

        •  Oh and you didn't even mention john Roberts (5+ / 0-)

Association with Veronica's mother's attorney and the lies and deceptions!

          •  And the NYT investigation of Robert's own adoption (0+ / 0-)

There is some talk that Roberts should have recused himself as an adoptive father, particularly since an initial NYT investigation showed that his own adoption of two Irish children through a South American country may have been done illegally.  The NYT called off the investigation to protect the children, but the Tea Party and ilk have broadcast it far and wide that Robert's illegal adoptions were used as blackmail fodder by Obama, allowing him to pressure Roberts into a yes vote on the ACA.  It's a bit far out there, but it looks like Roberts did engage in an illegal adoption (Irish children cannot be adopted by non-Irish residents) which would bias him against any sort of paternal rights case (but I guess you can't recuse yourself if it means admitting to your own illegal activities).  Thomas's adoption(s) appear to be above-board so there was no need in his case.

        •  It's almost a conspiracy (0+ / 0-)

The more that becomes revealed about the Veronica Brown case, the more it appears that there are some duplicitous undercurrents.  Rumors abound, but I've seen it said that Judge Martin, the SC Family Court judge, is being investigated for his connection to Melanie Duncan Capobianco's father, who supposedly was the Speaker of the House in the SC Senate.  Judge Martin did not follow SCOTUS and SC law by allowing Veronica Brown to be adopted without the components of ICWA that SCOTUS ruled did apply and he did not give her a best interests hearing, which I believe was also required.  And Judge Toal, the SCSC who reversed her original vote which confirmed Martin's decision, is a known drunk driver with several hit-and-run instances under her belt, which could have made her vulnerable to political pressure to change her vote.  And why on earth were two Republican Governers, Nikki Haley and Mary Fallin, directly threatening Dusten Brown (or even involved at all in a custody dispute)? How is it that Dusten Brown got charged for felonious custodial interference, but the Capobiancos were able to get away with the same behavior for months longer and never be charged with anything?  How is it the Capobiancos falsified documents for ICWA and submitted erroneous information for the ICPA and have no consequences?  Or that they disobeyed two gag orders by the court, including many appearances on national television?  They've also marketed perfume, t-shirts and purportedly liquor with Veronica Brown's image on is disgusting.  The whole thing reeks to high heaven, but I guess that's what money and political connections buy you today...your very own Cherokee baby.
