    That's why we have the Supreme Court, and Courts of Appeal, that we are now stuck with and struggling with -- because the Republicans did not hesitate to appoint the most right-wing ideologues they possibly could, and do it on 51-49 votes if they had to.

    Wikipedia reminds us: The Thomas confirmation process was highly contentious -- VP Dan Quayle presided, in case his vote was needed to break a tie -- and we lost, 52-48, even though the Democrats controlled the Senate (and Joe Biden chaired Senate Judiciary). If the Democrats had insisted on a 60-vote cloture vote first -- the very thing the GOP now claims is somehow baked into the Constitution -- the nomination would have gone down.

    So all the frothing about this being "nuclear" is sheer nonsense and please let's stop using that framing. It's a minor rules change that restores the way things normally worked until Jan. 20, 2009.
