  •  Like full auto? No. (0+ / 0-)

Automatic rifles, grenades and rocket launchers can all be banned. I also don't have a constitutional issue with magazine limits.

But I'm not going to pretend that an AR-15 with a 5 round clip that fires a .223 Remington, the most popular hunting round, isn't a hunting rifle. What makes it unusually dangerous?

Based on the number of deaths,  you should consider the handgun to be more dangerous than an AR-15.

"Dangerous and Unusual" are too poorly defined for a discussion of constitutional rights. Be more specific.

    •  That's Scalia's term "dangerous and unusal" and (4+ / 0-)

I'm guessing he left it intentionally poorly defined, in order to give future courts a lot of leeway in what weapons they think should be banned.

You're case about the AR-15 leaves out an important variable in the equation - the rate of fire. If you can spray out 30 rounds quickly, then an AR-15 (or any semi-auto) plus high cap mags is doing just about the same as fully auto.

Or event 5 rounds is very short amount of time. 3 rounds, like hunting regulations require now, is all you need to hunt. You don't want to turn a deer into lead laced hamburger, do you?

Dangerous and unusual means to the MAJORITY of the citizenry. After all, it is a tiny minority that thinks AR-15s are appropriate hunting weapons and not the assault weapons they were designed and marketed to be. Most Americans don't know what an AR-15 is, but if they do it is usually because some nutjob has used one in a mass shooting.

      •  so the second amendment (0+ / 0-)

only means what the majority of people approve of?  What was the point of writing it down then?

Does the First Amendment only apply to speech that a majority of Americans find neither dangerous nor unusual?

        Also: Fuck Scalia.

Politics means controlling the balance of economic and institutional power. Everything else is naming post offices.
