    The NLRA doesn't apply to third parties (unless they are acting as agents of management or the union, and even then, only the employer or union would be liable for the third party/agent's acts).

    The charge against Rep McGovern was probably dismissed for lack of jurisdiction.  Or perhaps, because it didn't state a claim for a violation of the Act--a Congressman saying he'd vote for the union has no tendency to interfere with employee free choice (see NLRA Sections 7 and 8).
