    Do you have some indication that previous Duke ratecases included costs for disposal other than ponds?  If not, I have to agree with Shamash, above.

    To the extent ponds were/are imprudently maintained and costs to refurbish or cleanup are related to that imprudence, it would be appropriate to penalize shareholders, thus Dan River makes sense as not being included in rates.
