    detainees remain detained stated that Pakistan and Afghanistan governments were both requested to not accept any detainees which they would subsequently release.

    While it is agreed Hamdan has never been a real threat, I find it hard to believe GWB is moderating even in the final days of his administration when  the DOJ continued its prosecution of the Holy Land Foundation:

      someone after his term was up was something even Bush couldn't deal with. Do I know that? Of course not. But given the reversal of the strongly worded DoD outrage upon Hamdan's sentence, I think it more than likely.

        after a mistrial last year if we are seeing moderation or even temperance?

          all the scales have dropped from Bush's eyes. The HLF case involves different laws and different circumstances and is something pushed by our Mideast "ally." The law is written so loosely it is easily abused, which I think is the situation here. But Guantanamo is a PR nightmare, very different from HLF.
