  •  So is it really now up to the Governor-General? (1+ / 0-)

Any precedent for how she should or would decide?

Could she go "Australia" on the parties and force a General Election against the advice of the party leaders?

(By "Australia", I'm referring to the situation back in the '70s where Governor-General Kerr forced a general election over the objections of then PM Whitlam.)

    •  She could, legally (2+ / 0-)

But she won't.  Consider also the King-Byng Affair in Canada - although that situation was slightly different.  The GG doesn't lightly disregard the advice of her or his Prime Minister.  But given the clear indication that there is a viable government in waiting, she'll be criticized regardless of how she responds.

They happen so infrequently that nobody knows what is a constitutional convention and precedent and what is not. In law, the GG could fire Harper on the spot with or without a defeat in parliament, because the PM serves at her pleasure and all executive power is vested in the Crown (although it is a constitutional convention that in general she will not act against the wishes of the elected government)

Even if she decided to exercise her reserve powers in a very funny way and against the popular will, there is nothing anyone could really do. Her decisions as GG cannot be judicially reviewed. It would, however, create a constitutional crisis in which her office and the role of the monarchy in Canada would be questioned.
