    I hate Phelps. I hate the WBC. But they have every right to do what they do. It stinks. It's abusive of the law and the principles of our country. But the constitutional right to free speech allows it.

    A Congressional statute cannot supersede the Constitution. This law is going to be found unconstitutional, I can almost guarantee it. Barney Frank, David Wu and (I hate to say it) Ron Paul were right about this one.

      The act in question, at least if the summary at the wiki link above is correct, is nothing more than a time, place, and manner restriction--of the sort that the Supreme Court has upheld dozens or hundreds of times before. True, the act wouldn't be needed if the Phelps clan had any shred of human decency, but since they don't, I have zero problem telling them that they can't traumatize the family and the loved ones of a soldier at the precise moment when they're laying him/her to rest.
