    trying to sell it on Constitutional grounds is silly and counter productive. The current illegal status of marijuana does not violate the Constitution of the United States any more so than did the prohibition against alcohol. Trying to justify passage of the proposition on constitutional grounds makes it look like this is nothing more than a bunch of not serious kids trying to make it so they can smoke some weed legally.

    There are enough solid benefits to this prop's passage that you don't need to throw this other stuff out there.

      Then why did Congress pass the Volstead Act to ban alcohol? Because it was beyond their comprehension that there was any other legal means other than a Constitutional Amendment.
      But now, we feel that our government can arbitrarily restrict our behaviors, and they do not hesitate to pass laws and hand out harsh fines and imprisonment.

        maintain arguing that the laws which make marijuana possession and use illegal somehow infringe upon an individual's Constitutionally guaranteed right to the pursuit of happiness is a BIG stretch and comical. I'll give anyone who promotes that angle credit for being able to keep a straight face when they do it, but it's just not serious. I'm pretty confident we'd be hard pressed to find any con law scholar, practioner or judge who would agree this particular prohibition violates any Constutionally guaranteed rights. Thanks.
